H-Rera issues notice to Supertech for initiating sales without permission

The Haryana Real Estate Regulatory Authority (H-Rera) has issued a showcause notice to Supertech developer for starting sales without prior approval from the authority. There are four such kinds of Supertech projects where they have initiated sales without due permissions.

H-Rera has given a week’s time to the Supertech developer to respond to the showcause notice. The developer has been asked to explain why a penal action should not be taken against them.

Under sections 15(1) and 61 of the Real Estate (Regulation and Development) Act, 2016, a developer is required to take approval from the authority before starting the sales of the properties.

It is also mentioned that if a developer fails to comply with this then they are liable to penalties which can exceed up to the 5 per cent of the cost of the project.

Supertech has been given showcause notice for two projects in Gurugram and two in Sohna. As per a report published in the TOI, H-Rera has already proposed a consolidated penalty of Rs 85 crore for all the four projects.

RK Arora, Chairman of the Supertech Group, defended the company by saying, “Contrary to the reports, we have not started sales. The H-Rera has issued showcause notice without having any concrete evidence. We will reply to them with facts and evidence.”
